Box Tree Moth Order

In the matter of a box tree moth (Cydalima perspectalis) infestation located in the Provinces of Ontario, Quebec, New Brunswick, Nova Scotia, Prince Edward Island, and Newfoundland and Labrador

And

Pursuant to subsection 15(3) of the Plant Protection Act, S.C. 1990, C. 22

It is hereby declared that the provinces of Ontario, Quebec, New Brunswick, Nova Scotia, Prince Edward Island, and Newfoundland and Labrador are infested with box tree moth (Cydalima perspectalis);

And it is hereby ordered that:

Interpretation

1.

In this Order,

"infested place" means the place described in Schedule 1.; (lieu infesté)

"inspector" means a person designated as an inspector pursuant to section 21 of the Plant Protection Act; (inspecteur)

"movement certificate" has the same meaning as in section 2 of the Plant Protection Regulations; (certificat de circulation)

"pest" means the box tree moth [Cydalima perspectalis(Walker)], in all its life stages; (organisme nuisible)

"regulated thing" means boxwood plants for planting (Buxus spp.), including rooted and unrooted cuttings. (chose réglementée)

Prohibitions or restrictions of movement

2.

No person, except an inspector, shall move or cause the movement of the pest out of the infested place unless authorized beforehand to do so by an inspector under and in accordance with a movement certificate.

3.

No person, except an inspector, shall move or cause the movement of a regulated thing out of the infested place unless the person is authorized beforehand to do so by an inspector under and in accordance with a movement certificate.

Section 3 does not apply to a regulated thing that originates from outside the infested place if

  • a) it enters and leaves the infested place between November 1 and May 15, and
  • b) it is segregated from regulated things that originate from the infested place.
