Primary control zone for multinucleate sphere unknown (MSX) and/or Dermo (PCZ-11 – Pointe Sapin to Fagan Point, NB)

Revocation Order (Section 27.3 of the Health of Animals Act)

WHEREAS I, Paul MacKinnon, President of the Canadian Food Inspection Agency, am of the opinion that the order declaring the primary control zones set out in the Schedule attached hereto are no longer necessary as these are now amalgamated under the primary control zone (PCZ) 09.

WHEREAS I am authorized under section 27.3 of the Health of Animals Act^{Footnote 1} (the Act) to revoke an order made under subsection 27(1) of the Act;

THEREFORE, I hereby revoke the Declaration Orders made pursuant to subsection 27(1) of the Act in respect of the primary control zones set out in the Schedule attached hereto;

AND THEREFORE, I hereby also revoke the Designation Orders made pursuant to subsection 27(2) of the Health of Animals Act in respect of the animals and things set out in the Schedule attached hereto.

Schedule

WHEREAS, on November 29, 2024, primary control zone 11 was declared by Jean-Guy Forgeron, the Executive Vice-President of the Canadian Food Inspection Agency, under subsection 27(1) of the Health of Animals Act^Footnote 1 for Haplosporidium nelson and/or Perkinsus marinus; and whereas I am authorized under section 33 of the Act to exercise the power of the Minister under subsection 27(2) of the Act.

THEREFORE, under subsection 27(2) of the Act, in respect of that primary control zone, I hereby, by order, designate the animals and things listed in the Schedule attached as being capable of being infected or contaminated by Haplosporidium nelsoni and/or Perkinsus marinus.

Oysters and their spat, both wild and cultured, alive or dead and any parts thereof.

AND

Things that have been in contact with oysters or their spat, both wild and cultured, alive or dead and any parts thereof.

WHEREAS I, Jean-Guy Forgeron, Executive Vice-President of the Canadian Food Inspection Agency, under the delegated authority of the Minister of Agriculture and Agri-Food (the Honorable Lawrence MacAulay), believe that the reportable diseases, Haplosporidium nelson and/or Perkinsus marinus, exist in the area in Canada described in the schedule attached hereto.

THEREFORE, I hereby declare, pursuant to subsection 27(1) of the Health of Animals Act^Footnote 1, that the area described in the Schedule attached is a Primary Control Zone, effective the date below.

• All waters within lines drawn at points 46.964547° north latitude, -64.826735° west longitude near Pointe-Sapin, 46.969037° north latitude, -64.5296° west longitude east of Pointe-Sapin, 46.346648° north latitude, -64.232729° west longitude north of Fagan Point, and 46.228176° north latitude, -64.230053° west longitude near Fagan Point.
