Proposed amended livestock feed ingredient – Marigold oil extract: Closed consultation

About the consultation

The Canadian Food Inspection Agency (CFIA) was seeking comments on the reclassification and amended single ingredient feed (SIF) description for marigold oil extract.

Background

The Feeds Regulations, 2024 require a proponent to submit a pre-market application for new feed ingredients or SIFs that have been modified such that they differ from an approved SIF, or SIFs that are for a new purpose. The CFIA evaluates the information in the application to establish that the SIF is safe, effective, and labelled correctly.

Approved SIFs are listed and described in the Canadian Feed Ingredients Table (CFIT), which is incorporated by reference (IBR) into the Feeds Regulations, 2024. The CFIA's Incorporation by Reference Policy requires that a consultation be conducted before changes to IBR documents are made. Refer to Documents incorporated by reference under the Feeds Regulations, 2024 for additional information.

About the evaluation

The CFIA's Animal Feed Program (AFP) has identified that marigold oil extract has been classified incorrectly in the CFIT. Currently, this SIF is classified and listed in Subclass 6.6 (Colourants for livestock feeds) in Class 6 (Non-nutritive ingredients), indicating that it was assessed and approved to colour livestock feeds. However, this SIF was assessed and approved with the purpose of modifying the colour of foods of animal origin when fed to livestock species. It was not approved as a colourant to colour the livestock feed.

In addition to recommending that this SIF be reclassified in the CFIT based on its approved purpose, the description should be amended to clarify the original approved purpose (approved for use in registered food modifying agents for livestock species to modify the colour of edible tissues of animal origin), and to include standardized wording that is found in the new proposed description for saponified paprika oleoresin and the amended description for saponified marigold oleoresin, which are approved for the same purpose.

Therefore, the CFIA recommends marigold oil extract be moved from Subclass 6.6 (Colourants for livestock feeds) in part 1 of the CFIT to Subclass 6.16.1 (Food modifying ingredients – non-microbial) in Class 6 (Non-nutritive ingredients) in part 1 of the CFIT, and the amended SIF description replace the current SIF description in the CFIT, accordingly.

Reclassified and amended SIF description

The CFIA intends to reclassify marigold oil extract and move this SIF from Subclass 6.6 (Colourants for livestock feeds) in part 1 of the CFIT to Subclass 6.16.1 (Food modifying ingredients – non-microbial) of Class 6 (Non-nutritive ingredients) in part 1 of the CFIT.

In addition, the CFIA intends to amend the existing SIF description for marigold oil extract. The amendments to this description include clarifying the purpose of the SIF (that is, approved for use in registered food modifying agents for livestock species to modify the colour of edible tissues), and adding standardized wording/statements to be consistent with the saponified paprika oleoresin and saponified marigold oleoresin descriptions.

The amended description is:

Marigold oil extract (or Tagetes erecta L. oil extract)

is the oil extract derived by hexane extraction of the flower petals of marigold (Tagetes erecta L.).

This ingredient shall not contain more than 0.3% ethoxyquin.

This ingredient is approved for use in registered food modifying agents for livestock species to modify the colour of edible tissues of animal origin.

It may be blended with suitable carriers listed in the Canadian Feed Ingredients Table to standardize the total carotenoid concentration.

If a carrier is used, it must be approved for use in livestock feeds, it shall be used at the approved rate, and the common name or names shall be indicated on the label.

If an antioxidant is used, it must be approved for use in livestock feeds, it shall be used at the approved rate, and the common name or names shall be indicated on the label.

The ingredient number will be amended to reflect that the SIF has been moved from Subclass 6.6 to Subclass 6.16.1 in part 1 of the CFIT. Amendments were also made to the description to standardize the wording and to clarify the purpose of this SIF. This is a reclassification and amendment to an existing SIF description.

Additional information

During the drafting of the new description for saponified paprika oleoresin and making amendments to the saponified marigold oleoresin description, the CFIA's AFP identified that the existing description for marigold oil extract had been classified incorrectly in the CFIT. Marigold oil extract was assessed and approved to modify the colour of edible tissues when fed to livestock species and was not approve to colour the livestock feed. Therefore, marigold oil extract would be better classified under Subclass 6.16.1 (Food modifying ingredients – non-microbial) in part 1 of the CFIT.

In addition, some modifications should be made to this existing description for marigold oil extract to clarify the purpose (which is approved for use in registered food modifying agents for livestock species to modify the colour of edible tissues). This existing description was also updated to include some of the standardized wording found in the new description for saponified paprika oleoresin and the amended description for saponified marigold oleoresin.

Therefore, this SIF with the amended description will be moved to Subclass 6.16.1 (Food modifying ingredients – non-microbial) in part 1 of the CFIT.

Who was the focus of this consultation

Animal feed stakeholders, including:

  • suppliers of feed ingredients
  • commercial feed manufacturers
  • feed importers, distributors and retailers
  • industry associations
  • other government departments
  • international trading partners
  • veterinarians

All comments are welcome from industry, governments, the public, or other organizations or individuals.

How to participate

The CFIA is seeking feedback on the reclassification and amended description for marigold oil extract.

Stakeholders were encouraged to share comments if there was:

  • concerns about the accuracy of the SIF description and the intended purpose
  • any scientific data that should be considered before the SIF is reclassified and amended

The CFIA evaluators will review scientific questions or information for consideration in the evaluation. They will also evaluate non-scientific input and explore appropriate ways of addressing it.

Next steps

The CFIA will review all of the comments received. If no significant scientifically valid concerns are raised, the CFIA will finalize the classification and the amended description for marigold oil extract.

If significant concerns are raised, the CFIA will evaluate the additional information. A what we heard report that summarizes the feedback received will be published.

This SIF will be moved from Subclass 6.6 (Colourants for livestock feeds) to Subclass 6.16.1 (Food modifying ingredients – non-microbial) in Class 6 (Non-nutritive ingredients) of part 1 of the CFIT, and the amended SIF description will be added to the CFIT at the next update.
