Description for flow chart showing CVB management of nonconformities and enforcement actions under the Canada Organic Regime Appendix E: Initial Application / Reassessment for Accreditation (1st part):
  1. The Conformity Verification Body (CVB) conducts an on-site visit and issues a report to the applicant Certification Body (CB) as per section B.2.2.17 of the Canada Organic Regime (COR) operating manual. The applicant CB has 30 working days from report receipt to submit responses to resolve any NCs.
    1. If the response is submitted on time and the actions taken/responses are sufficient and effective to resolve NCs, CFIA accepts CVB recommendation and grants accreditation to the applicant CB.
  2. In order for the CVB to properly assess if actions taken/responses are sufficient and effective to resolve NCs, further info may be requested and/or assessment activities may be conducted. Also, In the case of reassessment, the CVB needs to consider the expiration date of CB current accreditation letter and manage any additional period granted.
    1. If the response is submitted in a timely manner and the actions taken/responses are sufficient and effective to resolve NCs: CFIA accepts CVB recommendation and grants accreditation.
    2. In the case where the responses are not submitted on time and/or found to be unacceptable, CFIA accepts the CVB recommendation and does not grant accreditation to the applicant CB. CVB sends notice of refusal in writing to the applicant CB with rationale and obtains confirmation of receipt. CB has the right to request that CFIA reviews the CVB decision within 30 days from notice receipt as per SFCR part 13 section 362.
    3. In the case of reassessments, follow Appendix F from point 4 onwards (in the description).
  3. Applicant CB's request for review is sent to CFIA:
    1. CFIA reviews CVB decision.
    2. If CFIA does not agree with the CVB decision and accepts the applicant CB's application, CFIA accredits the CB and notifies the CB and CVB in writing as per SFCR part 13 subsections 361(1) and (2) and section 363.
  4. If Applicant CB does not request a review:
    1. CFIA confirms the CVB decision. CFIA notifies the applicant CB in writing that accreditation was refused as per SFCR part 13 section 363.
