1. Purpose

The purpose of the fish export policy is to define the intent and objective of the Fish Inspection Act and Regulations, the approach taken by the Canadian Food Inspection Agency (CFIA) to regulate the export of fish and fish products, and the roles and responsibilities of fish exporters.

2. Authority

This regulatory policy is issued under the authorities of the Fish Inspection Act and the Fish Inspection Regulations.

3. Scope

This policy applies to all exporters of fish and fish products. This policy applies to the CFIA and its authorized representatives or agents who are responsible for enforcing the Fish Inspection Act and Fish Inspection Regulations.

4. Definitions

Export - means to ship from Canada to any other Country or from any province to any other province.

Certificate - a paper or electronic document issued by the CFIA that describes and attests to attributes of consignments of fish destined for international trade.

5. Policy Statement

The objective of the Fish Inspection Act and Fish Inspection Regulations is to provide reasonable assurance exported fish products were processed under sanitary conditions, are safe for human consumption, are wholesome and properly identified.

To achieve this, the CFIA is committed to implementing an export program that generates compliance with the Act and Regulations while facilitating the trade of products that meet Canadian requirements and the requirements of Canada's trading partners.

6. Policy Requirements

6.1 The exporters are responsible for ensuring the products they export are harvested, processed, transported, handled and stored in a manner that meets Canadian requirements and the requirements of the importing country.

6.2 The CFIA applies a risk based approach to regulate the processing and preparation of fish for export along the entire production chain and verifies that exporters are fulfilling their responsibility to comply with the Act and Regulations and any requirements known to the CFIA as set by the competent authority of the importing country.

6.3 The CFIA issues an Export Certificate for fish when required to satisfy conditions for clearance set by the importing country's competent authority.

6.4 The CFIA works with Canada's trading partners to negotiate mutually acceptable export certificates, resolve trade issues and maintain market access for Canadian exporters.
