Revocation order

Revocation Order (Section 27.3 of the Health of Animals Act)

WHEREAS, I, Dr. Harpreet S. Kochhar, President of the Canadian Food Inspection Agency, am of the opinion that the order declaring the primary control zone set out in the Schedule attached hereto is no longer necessary with regard to highly pathogenic avian influenza that may affect animals or that may be transmitted by animals to persons.

WHEREAS I am authorized under section 27.3 of the Health of Animals ActFootnote 1 (the Act) to revoke an order made under subsection 27(1) of the Act;

THEREFORE, I hereby revoke the Declaration Order made pursuant to subsection 27(1) of the Act in respect of the primary control zone set out in the Schedule attached hereto;

AND THEREFORE I hereby also revoke the Designation Order made pursuant to subsection 27(2) of the Health of Animals Act in respect of the animals and things set out in the Schedule attached hereto.

Amended Designation order

WHEREAS on February 10, 2023, the boundaries of Primary Control Zone 173 described in the schedule of a Primary Control Zone Declaration Order (referred to in this order as "Declaration Order") were amended by the Acting President of the Canadian Food Inspection Agency, pursuant to subsection 27.3 of the Health of Animals ActFootnote 1 (the "Act") in respect of highly pathogenic avian influenza;

WHEREAS, as an inspector, I am authorized under section 33(1) of the Act to exercise the power of the Minister under subsection 27(2) of the Act;

WHEREAS on February 3, 2023, a Designation Order was made under subsection 27(2) of the Act designating animals and things as being capable of being affected or contaminated by highly pathogenic avian influenza for Primary Control Zone 173.

AND WHEREAS as an inspector, I am also authorized  under section 33(2) of the Act to exercise the power of the Minister under section 27.3 of the Act to amend an order made under subsection 27(2) of the Act.

THEREFORE, by this order, I amend the Designation Order made on February 3, 2023 to refer to the amended Declaration Order made on February 10, 2023 for Primary Control Zone 173.

Amended Declaration order

WHEREAS on February 3, 2023, I, Jean-Guy Forgeron, Executive Vice-President of the Canadian Food Inspection Agency, declared Primary Control Zone 173 in a Declaration Order, pursuant to subsection 27(1) of the Health of Animals ActFootnote 1 (the Act) in respect of the highly pathogenic avian influenza.

WHEREAS I am authorized to exercise the power of the Minister under section 27.3 of the Act to amend an order made under subsection 27(1) of the Act.

THEREFORE, by this order, I amend the Primary Control Zone described in the Schedule of the Declaration Order referred to above by replacing it with the Primary Control Zone described in the attached Schedule.

Archived Designation order - 2023-02-03

WHEREAS, on February 3, 2023 primary control zone 173 was declared by Jean-Guy Forgeron, Executive Vice-President, acting as President of the Canadian Food Inspection Agency, under subsection 27(1) of the Health of Animals ActFootnote 1 for highly pathogenic avian influenza; and whereas I am authorized under section 33 of the Act to exercise the power of the Minister under subsection 27(2) of the Act.

THEREFORE, under subsection 27(2) of the Act, in respect of that primary control zone, I hereby, by order, designate the animals and things listed in the Schedule attached as being capable of being infected or contaminated by the highly pathogenic avian influenza.

CommercialFootnote 2 or non-commercialFootnote 3 poultry. This includes day-old poultry and hatching eggs, eggs and other products or by-products of such captive domestic poultry, and things that have been exposed to such a bird.

AND

Other captive birds (including birds that are raised in captivity for racing, exhibitions, zoological collections, competitions, or pets) if movements may result in contact with commercial or non-commercial poultry or their facilities. This includes eggs, other products or by-products of other captive birds, and things that have been exposed to such a bird.

WHEREAS, I, Jean-Guy Forgeron, Executive Vice-President, acting as President of the Canadian Food Inspection Agency, under the delegated authority of the Minister of Agriculture and Agri-Food (the Honorable Marie-Claude Bibeau), believe that the disease, highly pathogenic avian influenza, exists in the area in Canada described in the schedule attached hereto.

THEREFORE, I hereby declare, pursuant to subsection 27(1) of the Health of Animals ActFootnote 1, that the area described in the Schedule attached is a Primary Control Zone, effective the date below, in which I believe that highly pathogenic avian influenza exists.
