On June 29, 2021, in the Ontario Court of Justice in Chatham, Ontario, Presteve Foods Limited (Ontario Corporation 5027989) of Wheatley, Ontario pled guilty and was convicted of 2 counts of contravening section 6(1) of the Safe Food for Canadians Act. Presteve Foods Limited was ordered to pay a total fine of $400,000.
Between January 28 and March 11, 2019 Presteve Foods Limited labelled and sold previously frozen fish as "fresh". This is contrary to section 6(1) of the, Safe Food for Canadians Act (SFCA), which is an offence under section 39(1) of the SFCA. All counts against the Presteve Foods Limited CEO/President Ulysses Pratas and General Manager/Executive Vice-President Abraham Schmitt were withdrawn.
Subsection 6(1) of the SFCA states that it is prohibited for a person to manufacture, prepare, package, label, sell, import or advertise a food commodity in a manner that is false, misleading or deceptive or is likely to create an erroneous impression regarding its character, quality, value, quantity, composition, merit, safety or origin or the method of its manufacture or preparation.
