Administrative monetary penalties

Under the Agriculture and Agri-Food Administrative Monetary Penalties Act and Regulations, the Canadian Food Inspection Agency (CFIA) may issue an administrative monetary penalty (AMP) as an enforcement measure to encourage compliance with the Health of Animals Act, the Plant Protection Act, the Safe Food for Canadians Act and their associated regulations.

Additional information

An Administrative Monetary Penalty (AMP) can be either a notice of violation with a warning, or a notice of violation with a penalty.

  • The amount of the penalty given to a person for a violation that is committed other than in the course of business, and that is not committed to obtain a financial benefit can be between $500 and $1,300
  • The amount of the penalty given to a person for a violation that is committed in the course of business, or in order to obtain a financial benefit can be between $1,300 and $10,000
  • Penalties can be increased by 50% of the original penalty based upon the gravity of the violation and the compliance history of the violator, up to a maximum of $15,000

If an individual or a company receives a Notice of Violation, they may request a review of the facts. The review is made by the Minister of Agriculture and Agri-Food Canada and/or the Canada Agricultural Review Tribunal. The review can also go the Minister and then to the Review Tribunal.
