CFIA cancels the Safe Food for Canadians Licence #8HMG4GLC of The Beef Boutique LTD. (operating under St. Ann's Foods Inc.)
December 2, 2019, Ottawa: The Canadian Food Inspection Agency (CFIA) has cancelled the Safe Food for Canadians licence #8HMG4GLC of The Beef Boutique LTD., operating under St. Ann's Foods Inc., located in Toronto, Ontario, effective December 2, 2019.
Prior to the cancellation, the licence of The Beef Boutique LTD. was suspended on September 21, 2019. During a licence suspension, licence holders may not conduct any activity that is identified in their licence.
The licence was suspended in accordance with section 35 of the Safe Food for Canadians Regulations (SFCR), because of the opinion that a risk of injury to human health may result if the licence holder continues to conduct an activity that is identified in their licence. It was determined as part of a food safety investigation that the licence holder had failed to implement effective control measures in accordance with Part 4 of the SFCR.
There were numerous food recalls related to E. coli O157:H7 in various beef and veal products associated with this food safety investigation.
During the investigation, the CFIA also determined that the company failed to comply with Section 15 of the Safe Food for Canadians Act relating to E. coli lab results. Section 15 provides that it is prohibited to make a false or misleading statement or to provide false or misleading information to a person exercising duties under the Act in connection with the Act or the SFCR. Non-compliance with this provision is grounds for cancellation under section 39 of the SFCR.
The Beef Boutique LTD. was notified on October 22, 2019 of the grounds being considered for licence cancellation and provided an opportunity to be heard. After meeting with the licence holder regarding the cancellation, based on a review of the facts and submissions made, the CFIA determined that the licence holder failed to comply with section 15 and cancelled their licence.
