Musgrave Enterprises Ltd. fined $15,000.00 for offences under the Feeds Act

March 28, 2017, Ottawa: On March 9, 2017, in Manitoba Provincial Court in Brandon, MB, Musgrave Enterprises Ltd. pleaded guilty to one count of contravening paragraph 3(1)(b) of the Feeds Act, one count of contravening paragraph 3(1)(c) of the Feeds Act, and one count of contravening subsection 3(3) of the Feeds Act. The Company was ordered to pay a fine of $15,000.00.

Paragraphs 3(1)(b) and 3(1)(c) of the Feeds Act states that no person shall manufacture, sell or import into Canada any feed unless the feed conforms to prescribed standards (paragraph 3(1)(b)) and is packaged and labelled in accordance with the regulations (paragraph 3(1)(c)).

Subsection 3(3) of the Feeds Act states that no person shall manufacture, sell, import or export, in contravention of the regulations, any feed that presents a risk of harm to human or animal health, or the environment.

The CFIA's investigation determined that on or between the 4th day of July and the 21st day of November, 2014, at or near McCreary, MB, Musgrave Enterprises Ltd. unlawfully manufactured and sold a feed, namely screenings containing ergot alkaloids and deoxynivalenol. The feed did not conform to prescribed standards and was not packaged or labelled in accordance with the regulations, contrary to paragraphs 3(1)(b) and 3(1)(c) of the Feeds Act. In addition, the feed presented a risk to animal health, which is in contravention of subsection 3(3) of the Feeds Act.
