On August 26, 2020, in the Ontario Court of Justice in Guelph, Ontario, Ms. Karley Sinclair of Fergus, Ontario pled guilty and was convicted of contravening section 65(1) of the Health of Animals Act.

Ms. Sinclair was ordered to pay a fine of $25,000.00.

Between February 25, 2017 and February 24, 2018 Ms. Karley Sinclair imported into Canada bovine semen – a germplasm of a regulated animal – without a permit issued by the Minister of Agriculture. This is contrary to section 11 (1)(a) of the Health of Animals Regulations, which is an offence under section 65(1) of the Health of Animals Act.

On May 10, 2018 the Canadian Food Inspection Agency (CFIA) executed warrants in Ontario and Alberta that resulted in a large seizure of unlawfully imported bovine semen. In addition to the fine, the court ordered the remaining seized bovine semen, 1553 straws in total, forfeited to Her Majesty in Right of Canada to be disposed of by the Minister of Agriculture. The Crown withdrew all remaining charges against Ms. Sinclair.
