On December 18, 2015, a conviction was registered in the Ontario Court of Justice in Windsor against Jer-Mar Foods Ltd., operating as Ontario Corporation number 538948. Subsequently, on February 24, 2016, sentencing was imposed in Windsor Court against Jer-Mar Foods Ltd. A subsequent appeal by Jer-Mar Foods Ltd., was dismissed by the Ontario Superior Court of Justice in February 2019, and a Motion for leave to appeal was dismissed by the Ontario Court of Appeal in February 2020.

The court fined Jer-Mar Foods Ltd., $6,000.

Jer-Mar Foods Ltd., was convicted of contravening sections 6(2)(e) and 6(2.2)(b) and (c) of the Fish Inspection Regulations, which is an offence under section 17.1 of the Fish Inspection Act.

The offences, which took place between September 20, 2010 and May 10, 2011, involved importing fish products without providing proper notification to an Inspector, and for moving these products without first being inspected or being advised that inspection was not needed.
