Revocation order

Revocation order (Section 27.3 of the Health of Animals Act)

WHEREAS I, Jean-Guy Forgeron, Executive Vice-President of the Canadian Food Inspection Agency, am of the opinion that the order declaring the primary control zones set out in the Schedule attached hereto are no longer necessary with regard to controlling the spread of Haplosporidium nelsoni (MSX) and/or Perkinsus marinus as movement control measures have been implemented under section 198(1) of the Health of Animals Regulations.

WHEREAS I am authorized under section 27.3 of the Health of Animals ActFootnote 1 (the Act) (the Act) to revoke an order made under subsection 27(1) of the Act;

THEREFORE, I hereby revoke the Declaration Orders made pursuant to subsection 27(1) of the Act in respect of the primary control zones set out in the Schedule attached hereto;

AND THEREFORE, I hereby also revoke the Designation Orders made pursuant to subsection 27(2) of the Health of Animals Act in respect of the animals and things set out in the Schedule attached hereto.

Amended designation order

WHEREAS, on August 8, 2024, primary control zone 05 was declared by Jean-Guy Forgeron, the Executive Vice-President of the Canadian Food Inspection Agency, under subsection 27(1) of the Health of Animals ActFootnote 1 for Haplosporidium nelsoni; and whereas I am authorized under section 33 of the Act to exercise the power of the Minister under subsection 27(2) of the Act.

THEREFORE, under subsection 27(2) of the Act, in respect of that primary control zone, I hereby, by order, designate the animals and things listed in the Schedule attached as being capable of being infected or contaminated by Haplosporidium nelsoni.

Declaration order

WHEREAS, I, Jean-Guy Forgeron, Executive Vice-President of the Canadian Food Inspection Agency, under the delegated authority of the Minister of Agriculture and Agri-Food (the Honorable Lawrence MacAulay), believe that the reportable disease, Haplosporidium nelsoni, exists in the area in Canada described in the schedule attached hereto.

THEREFORE, I hereby declare, pursuant to subsection 27(1) of the Health of Animals ActFootnote 1, that the area described in the Schedule attached is a Primary Control Zone, effective the date below.

The following is the description of the area in and around Darnley Point, Prince Edward Island declared to be a primary control zone under this order:

Primary Control Zone 05 (PCZ-05)

  • All waters from a line drawn at a point at 46.556997 north latitude, -63.689151 west longitude near Cabot Beach Provincial Park to 46.5579 north latitude, -63.699988 west longitude near Darnley Point, including inland rivers.

WHEREAS, on August 8, 2024, primary control zone 05 was declared by Jean-Guy Forgeron, the Executive Vice-President of the Canadian Food Inspection Agency, under subsection 27(1) of the Health of Animals ActFootnote 1 for Haplosporidium nelsoni; and whereas I am authorized under section 33 of the Act to exercise the power of the Minister under subsection 27(2) of the Act.
